Teller Street <br />Lakewood, Colorado 80235 <br />RE: Permit Number 199980194, Amendment Number 1 <br />Neiv Thornton Gravel Mine <br />Dear Mr. Refer: <br />This letter is in response to your request for an amendment to Department of the Army <br />(DA) permit 199980194 issued to Aggregate Industries, Inc. for the New Thomton Gravel Mine. <br />The permit authorized the impact of 24.1 acres of wetlands in Sections 9, 16, and 17, Township 2 <br />South, Range 67 West, Adams County, Colorado. <br />Before processing the amendment, this office requested you review the jurisdictional <br />determination done for the original permit to verify that all wetlands were connected, and <br />therefore, jurisdictional to the DA. You found that one wetland, 0.21 acre in size, in Area 1 was <br />isolated. Since you are mitigating impacts on a 1.5:1 ratio that means that the amount of <br />mitigation compensation for the site shall be reduced by 0.32 acre for a revised mitigation total <br />of 35.83 acres of mitigation. As a result of this finding, Special Conditions A and E of the <br />original pennit are replaced among the additional Special Condition outlined below: <br />r" <br />K The permittee agrees to create 35.83 acres of wetlands to mitigate for those wetlands directly <br />impacted as a result of the mining activity. In addition to this mitigation, the permittee agrees <br />that when the seep stream north of 104`s is relocated it will be constructed as a relatively <br />unconfined channel with a wide area for plant growth on each side of the stream emulating a <br />riparian comdor and will be longer and higher quality than the existing feature. Typical sections <br />of the existing channel and the proposed channel will accompany the detailed mitigation plan <br />referred to in Special Condition Q below. <br />L. The pennittee agrees to submit semi-annual reports (these and all other reports shall be <br />submitted to the Denver Regulatory Office, 9307 South Wadsworth Boulevazd, Littleton, <br />Colorado, 80128, and shall reference the permit application number) by the first of January <br />beginning in 2003 for every year the permit is in effect, indicating the status of the work and <br />shall include the following information: <br />a. Date permitted activity was begun; if work has not begun on-site, please so indicate. <br />b. Brief description and extent of work (projector mitigation activity) completed since <br />the previous report or since permit was issued. Indicate on copies of the permit drawings <br />those areas where work has been completed. <br />c. Brief description and extent of work anticipated in the next six months. Indicate on <br />copies of the pemut drawings those areas where it is anticipated that work will be done. <br />
