The Southern Pacific Railroad Company has trackage which traverses a portion of the proposed Eastem Mining <br />District. The track leads to Twentymile Coal Company's Foidel Creek Mine and is utilized by the mine to ship coal to <br />its customers. Discussions will be held with Southern Pacific representatives to secure approval to subside the track. <br />Three residences are located within the Eastern Mining District, and Cyprus is the owner of one of these residences. <br />Therefore, no problems are anticipated in obtaining land owner approval for undermining and subsiding the residence <br />owned by Cyprus. In reference to the other two residences, both owned by the same party, negotiations have been <br />initiated to obtain the appropriate approval. The negotiations have been finalized and Twentymile has the approval <br />to undermine the residences. <br />Finally, the Lieske Ditch headgate is located on Middle Creek and will fall within the subsided area. Cyprus is the <br />owner of this headgate and ditch, and has no problems with the undermining and subsiding of the headgate. <br />NORTHERN MINING DISTRICT (PR 99-OS) <br />The expansion of the mine into the Northern Mining District (NMD) will result in the undermining and subsiding of <br />structures located over the mining area. The area to be mined is depicted on Map 23, Mine Plan. The structures <br />located within the NMD include Routt County Road 33, Union Pacific Railroad, and powerlines. The major land use <br />in the area is for pastureland, with cropland and rangeland being minor land uses. <br />In reference to Routt County Road 33, TCC enlisted the services of SubTerra, Inc., to evaluate the potential impacts to <br />the road. The report is presented in Exhibit 7F-1. TCC will follow the recommendations within the road for <br />maintaining the road to ensure public safety. <br />The powerlines are located outside of the angle of draw resulting from mining in the NMD; therefore, TCC is not <br />anticipating any impacts to these lines. <br />The Union Pacific Railroad will be undermined and TCC will repair any damage to the track resulting from its mining <br />activities. TCC has successfully undermined sections of the track in the 9 Right, 8 Right and 7 Right longwall panels <br />without causing any significant impacts to the operation of the track. The maintenance and repair efforts were <br />coordinated with the UP personnel and this ahs resulted in a very efficient method for maintaining the track. This will <br />be continued as the mining moves into the Northern Mining District. <br />RULE 2.04.4 - CiJL.TURAL AND HISTORIC RESOiJRCE INFORMATION <br />The application shall contain a description of the cultural and historic resources listed on the national re iK stei <br />of historic places and knows archaeological features within all areas nronosed or likely to be affected by surface <br />activities or planned or yrobable subsidence, over the life of the mine. The descrintiou shall be based on all available <br />infornation, including. but not limited to, data of State and local archaeological, historical, and cultural preservation <br />agencies. <br />RESPONSE <br />An independent survey of the proposed permit and adjacent areas was conducted by Goodson and Associates, <br />Inc. of Denver, Colorado. This report provides a complete response to the requirements of this Rule. A copy <br />of the report, less confidential information, is presented in Exhibit 6, A Records Search and Reconnaissance <br />Survey for the Foidel Creek Mine Permit Area. Additional information on the sites identified in the cultural <br />• resource survey report was submitted to the CMLRD in the "Confidential Appendix" of this permit revision <br />application. <br />PR 03-06 2.04-8 03/17/04 <br />
