<br /> <br /> <br />Notice of Hearing to Consider <br />• Recommendation to Deny a Coal <br />Permit Renewal Application and Forfeit the Reclamation Bond <br />The Mined Land Reclamation Division (the Division) will recommend to the Mined <br />Land Reclamation Board (the Board) that an application to renew a valid, <br />existing permit to conduct coal mining and reclamation operations submitted by <br />Pueblo Coal, Inc. (PCI) for the Carbon Junction Mine (Permit No. C-82-054) be <br />denied. The Board will consider permit revocation or suspension and bond <br />forfeiture. <br />The Carbon Junction operation is located in La Plata County, approximately <br />2 1/2 miles southeast of Durango, Colorado. The mine is a surface coal mine <br />with an anticipated maximum production capacity of 500,000 tons per year. The <br />coal to be mined is privately owned, and the surface to be affected is <br />privately owned. The permit area encompasses approximately 530 acres in <br />Section 4, Township 34N, Range 9W; Section 33, Township 34 1/2 N, Range 9W; <br />and Section 33, Township 35N, Range 9W, N.M,P.M, <br />This recommendation to the Board is based on a finding that the proposed <br />operation will not comply with all requirements of the Colorado Surface Coai <br />Mining Reclamation Act, C.R.S, 34-33-101, et seq., and the regulations <br />promulgated thereunder. <br />At a previous Board hearing on December 14, 1989, the Board endorsed a letter <br />of agreement between the Division and PCI which required PCI to comply with <br />• certain permit renewal deficiencies by June 1, 1990. The Board ordered the <br />Division to re-schedule a formal hearing before the Board in June, 1990, if <br />conditions of the letter of agreement were not met. <br />As of June 1, 1990, two conditions of the letter of agreement had not been <br />met, resulting in the Division's denial recommendation. Copies of the <br />recommendation to not renew the permit are on file for public inspection at <br />the Mined Land Reclamation Division, Room 215, Centennial Building, <br />1313 Sherman Street, Denver, Colorado 80203 and at the County Clerk's office <br />in La Plata County. Persons with an interest that may be adversely affected <br />by the recommendation not to renew the permit must submit their objections to <br />the Minea Land Reclamation Board. Such objections shall be submitted within <br />thirty (30) days of the initial publication of this notice, must be in writinc <br />and must state with reasonable specificity the reasons for the objection to <br />the recommendation. A formal hearing before the Mined Land Reclamation Board <br />will be held in Room 220, 1313 Sherman Street, Denver, Colorado 80203 on <br />June 28, 1990, at 9:00 A.M. <br />. 7753E/scg <br />
