It is our <br />understanding that such an application will be made after approval of the SWSP. <br />Since groundwater is already exposed at the site, the applicant shall apply <br />for a gravel pit well permit immediately upon approval of this SWSP. The <br />provisions of §37-90-137(2) C.R.S. prohibits the issuance of a permit for a well <br />to be located within 600 feet of any existing well, unless the State Engineer finds <br />that circumstances so warrant after a hearing held in accordance with the <br />procedural rules in 2CCR402-5. This hearing may be waived if you are able to <br />obtain statements from the owners of all wells within 600 feet, verifying that they <br />have no objection to your use of the proposed well. Should a new well permit be <br />denied for reasons of 600 foot spacing, or any other legitimate reason, approval <br />of this SWSP will be cancelled. <br />3. The total surface area of the groundwater exposed at the North Tower Pit must <br />not exceed 28.0 acres during the approval period of this SWSP and the <br />maximum annual evaporative loss shall not exceed 98.0 acre-feet. Should the <br />total water surface area at the pit exceed 28.0 acres prior to the expiration date <br />of this SWSP, an amendment will need to be filed with this office. <br />4. Approval of this plan is for the purposes as stated herein. Any additional uses <br />of this water must first be approved by this office. <br />5. The Water Commissioner responsible for the administration for this plan is <br />Robert Stahl (9378 Weld County Road 25, Ft. Lupton, CO, 80621, 303-857- <br />0742). The applicant shall maintain daily records of all diversions, <br />replacements, and the amount of water used for each particular purpose. The <br />applicant shalt provide a report of these records to the Division Engineer and <br />the Water Commissioner on a monthly basis on a form approved by them. The <br />accounting shall be submitted within thirty (30) calendar days of the end of the <br />month for which the accounting is being made. <br />6. All diversions shall be measured in a manner acceptable to the Division <br />Engineer. The Applicant shall install and maintain such measuring devices as <br />required by the Division Engineer for operation of this SWSP. <br />7. A portion of the proposed replacement source for the depletions accruing to <br />the South Platte River resulting from this gravel pit is an "as Available" lease <br />agreement with the South Adams County Water and Sanitation District <br />(SACWSD). A copy of the executed lease agreement was submitted as part of <br />the application for this SWSP. Should water be needed from this source that is <br />not available, applicant will secure by all means practicable the water needed <br />prior to the depletion. <br />
