BANTA, D4rsctor
July 5, 1989
Mr. Terrell Johnson
Empire Energy Corporation
P.O, Box 68
Craig, Colorado 81626
RE: Eagle #5 & #6 Mines (Permit C-81-044) Ponds 9-P2 and 9-P3,
Inspected by ML RD June 21 and June 22, 1989,
Dear 14r. Johnson:
During the Division's inspection of the Eagle Mines June 21 and June 22, 1989,
certain characteristics of the above referenced ponds did not appear to
conform with MLRD Regulations. A check of the permit document and Division
files after the inspection did not uncover any approved desig,~s or
post-construction certifications for these ponds among the materials in the
Division's possession.
Apparently some survey or design must exist for the ponds. Review of the PAR
Response made August 12, 1988 for TR #11 which resulted in the approval of the
dewatering borehole 7 North Angle indicates that "each of the ponds has a
dewatering device in its bottom" (p. 2.05.3-37R) and that "these ponds will
allow 25.1 hrs. detention time in addition to the sump settling time"
(p. 2.05.3-37Ra).
In order to establish that these ponds conform to the conditions of the permit
(now including approved TR #11) and/or htLRD Regulations, the Division requests
that copies of approved designs and/or post-construction certifications,
surveys, etc. for these ponds be supplied as soon as possible.
If you have any questions on the above, please contact me.
Sincerely,
~~tt ~
~.Cv,;'~ h~ ~..tLt~
James C.
