Canany <br />1707 Cole Blvd Ste 100 Division Director <br />Natural Resource Trustee <br />Golden, CO 80401-3220 <br />Re: Cooley Reservoir & Fulton Wildlife Area, Amendment Approval, Permit No. M-1999-034, Revision <br />No. AM-1 <br />Dear Mr. Refer: <br />On June 25, 2003 the Colorado Mined Land Reclamation Boazd, considered the Division's recommendation and <br />approved the Amendment application submitted to the Division on February 12, 2003, addressing the following: <br />Add 5011 acres to permit area. <br />The terms of the Amendment No. 1 approved by the Division aze hereby incorporated into Permit No. M-1999- <br />034. <br />The conditions of the Boazd approval are noted below. Please note that all other provisions of Permit No. M-1999- <br />034 remain in full force and effect. <br />Stipulation No. Description <br />1 No de-watering or exhaction activities will occur until Aggregate Industries develops a plan to <br />monitor the gravel pit water for diisopropyhnethylphosphonate (DIIvIP) and obtains approval of that <br />plan from the Division of Minerals and Geology., The plan will include mondily sampling and <br />analysis to begin immediately after de-watering and/or extraction activities aze started. The montldy <br />monitoring will continue for one yeaz and then will change to quarterly monitoring until the <br />Division issues a letter authorizing discontinuance. The plan will include the sampling and <br />analytical methods to be used and an agreement to submit the results of the anaylsis to the Division <br />within 30 days of the sampling date. The samples will be obtainded and analyzed by a company, <br />individual, or agency certified to do the work. If an analysis shows a level of DIMP exceeding <br />8ug/L, Aggregate Industries or its agent will immediately notify the Division by certified mail and <br />include a response plan to deal with the contaminant, and to prevent on-site and off-site damage. If <br />the Division detemlirles from the monitoring data that there is a reasonable potential for the <br />operation to cause groundwater quality standazds for DIMP to be exceeded, the Division will notify <br />Aggregate Industries to modify the pemTit as necessary to comply with Subsection 3.1.7 of the <br />Rules. <br />2 Aggregate Industries-WCR, Inc. will monitor the Kazen Topper shallow well (well permit no. 2455) <br />for dusopropylmenthlyphosphonate (DIMP) initially before mining activities start in the <br />Amendment No. 1 area and again after de-watering stazs.
