. September 23, 1999
To Whom It May Concern,
Recently, we negotiated a lease with National King Coal, I_LC to mine coal which is
beneath the surface of land which is owned by us more particularly described as follows:
Section 5: E/2 SW/4, W/2 SE/4; "T34N, R11W N.M.P.M.
Part of the permitting process, they informed us, requires that an archaeologist perform a
survey to document any cultural resources which may be found on our property.
I feel that since this is an underground mine, there will be little chance for significant
surface disturbance. I do not wish to have any kind of archaeological survey done on
surface lands owned by me and will prohibit anyone from entering my property to do so.
This letter also serves to give permission to National Bing Coal, LLC staff to enter (with
prior written or verbal notice) the property mentioned above for the purpose of any
examinations required by law such as subsidence monitoring, surveying, etc.
• Sincerely, ~ G ~ g ~ r~/~a
[.G ~~ /
Richard Tipotsch
for: Richard Tipotsch, et al
•
