Earlier this year, we granted two "small area. exemptions" for
this mine (pursuant to our Rule 4.05.2(3)). Before we can issue such
exemptions, the operator must demonstrate that the drainage leaving the area
will "meet the effluent limitations of Rule 4.05.2 and the applicable state
and federal water quality requirements for downstream receiving waters." I
have enclosed a copy of our Rule 4.05.2 for your reference.
The two portions of the Apex No. 2 Mine for which exemptions were granted are
as follows:
1. A mine office location, which encompasses about 0.11 acres. This
parcel of ground includes an office building, and a graveled border
area. The building is outside of the mine drainage control
system. Drainage from the building area flows to a county road
ditch, which is not part of the mine drainage control system.
Drainage to the road ditch is predominately sheetflow.
2. A mine fan bench, which encompasses about 0.05 acres. The bench is
located on a hill slop e, and both the bench and hill slope are well
vegetated. Drainage from this bench would pass off of the bench,
then down the slope. There is no evidence of concentrated flow
leaving the fan bench, and the bench is outside the mine drainage
control system.
