• 2) Violation Notices <br />Date of Issuance: September 4, 1981 <br />Regulatory Authority: Colorado Mined Land Reclamation Division <br />• Violation No. 34-33-120(2)(d). Failure to establish and <br />protect all surface areas, including spoil piles, affected <br />by surface coal mining and reclamation operations to <br />effectively control erosion and attendant air and water <br />pollution. <br />Status: Pending decision from Division; Sediment and <br />Drainage Control Plan submitted to Division. <br />• Violation No. 34-33-120(2)(e). Failure to remove topsoil <br />from the land in a separate layer and stockpile with <br />adequate protection measures. <br />Status: Pending decision from Division. <br />• • Violation No. 34-33-120(2)(J)(II). Failure to conduct <br />surface coal mining operations so as to prevent additional <br />contributions of suspended solids to runoff outside the <br />permit area and failure to construct adequate siltation <br />control structures. <br />Status: A drainage and sediment control plan submitted to <br />the Division by Sunbelt. <br />• Violation No. 34-33-120(2)(p). Failure to ensure that all <br />reclamation efforts proceed in an environmentally sound <br />manner and as contemporaneously as practicable. <br />Status: Pending decision from Division. <br />• Violation No. 34-33-120(2)(q)&(R). Failure to construct <br />access roads in a manner which will control erosion, <br />minimize siltation, and refrain from altering the normal <br />flow of water down a channel. <br />• Status: A drainage and sediment control plan submitted to <br />the Division by Sunbelt. <br />2.03-13 <br />
