Cottony <br />Division Director <br /> Natural Resource Trostee <br />FROM: Joe Dudash <br />RE: Bowie No. 2 MI» ~', Permit No. C-1996-083, Bowie Resources LLC <br /> Groundwater Points of Compliance Report <br />As we had discussed previously, I am requesting your assistance in the review of a <br />hydrology report submitted by Bowie Resources LLC (BRL) in support of their <br />contention that the Bowie No. 2 Mine should receive a variance from the requirement for <br />down gradient groundwater point of compliance monitoring wells. Copies of the report <br />and cover letter are attached. <br />The May 2007 report was prepared by R Squazed Incorporated and concludes with a <br />request that BRL receive "a variance from installing groundwater monitoring compliance <br />wells in excess of 300 feet." I don't know if this request applies to only down gradient <br />groundwater point of compliance wells deeper than 300 feet or to all groundwater <br />monitoring wells deeper than 300 feet. <br />There is no formal decision due date for this review but the end of August would be a <br />good target date. If you need additional information or time, please let me know.
