This review is conducted to determine compliance with Rule 4.05.13(2)(a)(iii).
Result in reports to the Division, to include analytical results from each sample taken during the
quarter. Any sample results which indicate a permit violation will be reported immediately to
the Division. In those cases where the discharge for which water monitoring reports are
required is also subject to regulation by a NPDES permit issued under the Clean Water Act of
1977(30 U.S.C. Sec. 1251-1378) and where such permit includes provisions for equivalent
reporting requirements and requires filing of the water monitoring reports within 90 days or less
of sample collection, the following alternative procedure shall be used. The person who
conducts the surface or underground mining activities shall submit to the Division on the same
time schedule as required by the NPDES permit or within 90 days following sample collection,
whichever is earlier, either:
The subject report is due by Apri128. The subject report was submitted on April 7, 2003, and
received at the Division on Apri19, 2003. The report does not report the date of sample
collection. However, no sample was taken. The operator is asked to indicate dates of sampling in
their cover letter.
Rule 4.05.13(2)(a)(iii)(A) Acopy of the completed reporting form filed to meet NPDES permit
requirements; or
Acopy was provided. There was no discharge from Discharge Point OO l A (Sedimentation Pond
A).
