Stark Division of Minerals and Geology
Environmental Protection Specialist
Colorado Division df Minerals and Geology
1313 Sherman Street, Room 215
_ .Denver, Co. 80203
Re: Oxbow Mitiina, LLC, CDMG Permit C-1981-022,
Modification to 3rd Quarter 2005 Pond Inspection Report
Dear Mr. Stark:
On November 1, 2005, the Division sent OMLLC a letter requesting additional information
regarding ponds. OMLLC response is as follows:
1. Pond D -During the third quarter of 2005, Pond D discharged water. The attached
modified Inspection Report is corrected per the Division's request.
^~-.
2. Sediment and Water Level -When sediment enters a pond, it is deposited unevenly,
usually collecting at the inlets rather than evenly across the bottom of the pond. For this reason,
/^ sediment markers have limited utility and certainly contribute little to "accurate" sediment
estimates, Reported sediment levels are based upon the inspector's observations made throughout
the quarter during routine inspections in combination with knowledge of the pond structure.
The reported pond water level is also determined by observations relative to the various
landmarks in the pond (depth to bottom, primary riser, etc.)
OMLLC can provide such additional explanation in the report text.
Please call me at 970-929-5806 if you have any comments or questions.
Sincerely,
~N ~ n~
mes A.
