Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology has.completed review of the Discharge <br />Monitoring Reports for the 2nd 3rd and 4th quarters of 2003 for the New Elk Mine. <br />No discharge was reported during the 2"d quarter, which is consistent with field <br />inspection. Discharge was reported from outfalls at pond 7 and pond 8 in the 3`~ quarter <br />due to a storrn event. A violation of the alternate limitation for sediment (settleable <br />solids) was reported for the pond 7 outfall: For our records, please provide the DMG <br />with a copy of the response to the Water Quality Control Division correspondence of <br />January 9, 2004 concerning this exceedarice regarding measures to prevent a future <br />occurrence. No discharge was reported for the 4th quarter and that is consistent with <br />observations during DMG inspections. <br />We have no further questions at this time.
