Tev results shall be reported alone ~.vith the Discharge
Monitoring Report (DMR) submiued (or the reporting period during •.vhlch the sample was taken. (i.e., WET tnsnne
results for the firs[ calendar quarter ending ,March 31 shalt be reported wirh the D~~iR due April 23.) The resuhs
shall be submnted on the Acme Tozlcny Test report form, available from the Division. Copies of these reports arc w
be submnted to the Division along with the Di~1R.
The permittee shall conduct acute WET tests as follows: For outlalls 002, 003, 006, 010 and Ol l - a 43-hour WET
test using Certadaohnia sp.; (or out(all 005 ~ a 43-hour WET test using Daphnia magna; and for outlalls OI?. 013,
014, 016 and 0l7 - a 43-hour WET test using Ceriodaphnia sp. and an acute 96-hour WET test using fathead
minnows. Acute tests will be replacement static tests of a single effluent grab sample. The permittee shall conduct
each acute WET test in general accordance with methods described in Methods for Measuring the Acwe Toxicity of
Effluents and Receiving Waters to Freshwater and Marine Oreanisms, EPA/600!4-90/027 or the most current edition,
except as modified~by the most current Division guidance document entitled Guidelines for ConductingWhole
Effluent Tozic~ry Tests.
b. Failure of Test and Division Notification
An acute WET test is failed whenever the LCSO, which represents an estimate of the et0uent concentration which is
lethal to 50% of the test organisms N the time period prescribed by [he test, is found to be less than or equal to 100%v
effluent. The permittee must provide written notiflcatio^ of the failure of a WET test to the Division, along widt a
• statement as to whether the Preliminary Toxicity Incident ("PTI")/Toxicity Identification Evaluation ("TIE")
investigation or accelerated testing is being performed (see next section). Notification must he received by the
Division within l4 calendar days of the demonstration of acute WET in the routine required test.
"Demonstration" for the purposes of Patts I.A.4.b., c., d. and f. means no later than the last day of the laboratory
test.
Automanc Compliance S~edule Uoon Failure of Test
If a routine acute WET test is failed, the following automatic compliance schedule shall apply. As pan of this the
permittee shall either:
1. proceed to conduct the PTI/TIE investigation as described in Pan LA.4.d., or
ii. conduct accelerated testing using the single species found to be more sensitive.
If accelerated testing is being performed, [he permittee shall provide written notiDcation of the results within
la calendar days of completion of the "Pattern of Toxicity"/"No Toxicity" demonstration. Testing will be at least
once every two weeks for up to five tests tmtil 1) two consecutive tests fat! or three of five tests fail, in which case a
pattern of toziciry has been dernonsirated or, 2) two consecutive tests pass or three of five tests pass, in which case no
pattern of toxicity has been found. IF no pattero of toziciry is found the tonicity episode is considered to be ended and
romine testing is to resume. If a pattern of toxicity is found, a PTl/TIE investigation is to be performed. If a panern
of toxicity is not demonstrated but a significant level of erratic toziciry is found, the Division may require an
increased frequency of routine monitoring or some other modified approach.
d PTI/TlE
The results of the PTIITIE investiYation are to be received by the Division within 120 days of the
demonstration of acute WET in the routine test, :u defined above, or if accelerated testing is performted, the
• date the pattern of toxicity is demonstrated. A status reuort is m he ~nvided to the Division at the 30. 60 and
90 dayprrints of the PTI/TCE irrvestieation. Tite Dr: ision may extend the ume frame For imesuganon where
reasonable justificauon exists. A request for an extension must be made m wrung and received prior to th'e 1'_0 day
deadline.
