Modification Sus ension or Revocation of Permits B the Division <br />Continued <br />(iv) Promulgation of tonic effluent standards or prohibitions <br />(including any schedule of compliance specified 1n such <br />effluent standard or prohibition) which are established <br />under Section 307 of the Clean Water Act, where such a <br />toxic pollutant is present in the discharge and such <br />standard or prohibition is more stringent than any <br />limitation for such pollutant in this permit. <br />b) This permit may be modified in whole or in part due to a change in <br />any condition that requires either a temporary or permanent <br />reduction or elimination of the permitted discharge, such as: <br />(i) Promulgation of Water Quality Standards applicable to <br />waters affected by the permitted discharge; or <br />(ii) Effluent limitatioas or other requirements applicable <br />pursuant to the State Act or federal requirements; or <br />(iii) Control regulations promulgated; or <br />(iv) Data submitted pursuant to Part I.B indicates a potential <br />for violation of adopted Water Quality Standards or stream <br />classifications. <br />(v) Removal of a temporary modification to a stream standard <br />thereby requiring the application of the stream standard. <br />c) This permit may be modified in whole or in part to include new <br />effluent limitations and other appropriate conditions where data <br />submitted pursuant to Part I.B.3 indicates that such effluent <br />limitations and conditions are necessary to ensure compliance with <br />applicable water quality standards and protection of classified <br />uses. <br />d) At the request of the permittee, the Division may modify or <br />terminate this permit if the following conditions are met: <br />Code: i - 31 Date: 1-84, revised 12-88 <br />U <br />r1 <br />U <br />• <br />
