Walther <br />E.ecmi~e Director <br />Michael 8. Long <br />Division Dveaor <br />The Division has reviewed TCC's Dischazge Monitoring Reports, DMR's, for 1999 and 2000. Colorado <br />Department of Public Health and Environment CDPS permit no. CO-0042161 permits mine water <br />discharge from Outfall OOI, and wastewater discharge from Outfall 002, of the Foidel Creek Mine <br />CDMG permit (C-82-056). Outfa11001 dischazges to Fish Creek and Outfall 002 dischazges to Foidel <br />Creek. <br />Discharge monitoring reports were sent to the Division in accordance with CDMG Rule <br />4.05.13(2)(a)(iii) for the first three quarters of 1999. Fourth quarter 1999 DMR was submitted to <br />CDPH&E and CDMG late due to a lack of the proper documentation forms. TCC was in <br />communication with CDPH&E regarding the lack of forms and was not considered out of compliance in <br />this matter. All 2000 DMR's were submitted in a timely manner. <br />Permit limitation excursions from Outfall 001 were reported for the following quarters: <br />Second Quarter 1999 04/01/99-06/30/99 TSS <br />Fourth Quarter 1999 10/1/99-12/31/99 WET <br />Fourth Quarter 2000 10/1/00-12/31/00 WET <br />Permit limitation excursions from Outfall 002 were reported for the following quarters: <br />First Quarter 1999 <br />Fourth Quarter 1999 <br />First Quarter 2000 <br />Second Quarter 2000 <br />Third Quarter 2000 <br />Fourth Quarter 2000 <br />01/1/99-3/31/99 %BOD <br />10/1/99-12/31/99 %BOD <br />01/1/00-03/31/00 %BOD <br />04/1/00-06/30/00 %BOD <br />07/1/00-9/30/00 %BOD <br />10/1/00-12/31/00 %BOD <br />TCC reported the excursion to CDPH&E as required by Rule 4.05.13(2)(a)(ii). CDMG was notified of <br />permit limitation excursions. No State of Colorado CDPH&E or Federal water quality violations were <br />issued in 1999 or 2000 in compliance with Rule 4.05.1(3).
