Box 1430 <br />Palisade, CO 81526 <br />(970) 241-8118 <br />November 26, 2001 <br />Industrial Permit Compliance and Enforcement <br />Colorado Department of Public Health & Environment <br />WQCD-WQP-B2 <br />4300 Cherry Creek Drive South <br />Denver, CO 80246-1530 <br />RE: Powderhom Coal Company <br />Permit No. CO-0027154 <br />Noncompliance Notification <br />To Whom It May Concern: <br />Pursuant to Powderhom Coal Company's dischazge permit number CO-0027154, Part II, Section <br />A(4)(b), we are writing to report a noncompliance of effluent limitations on Outfall 004. The <br />oral notification was made via telephone to the Water Quality Control Division on Monday, <br />November 26, 2001 at approximately 3:00 pm by Tonya Hammond. <br />Powderhom Coal is in the process of drilling a new dischazge well, Outfall 016, that will become <br />effective on December 1, 2001. During this process, on Friday, November 16, as the hole <br />reached the proximity of the flooded workings, air pressure associated with the drilling forced <br />greater than anticipated quantities of water out of the hole. The quantity of water being made <br />during drilling would have overwhelmed the capacity of the cutting pit at the drill site and <br />Powderhom made the decision to haul water from the drill site to Pond 12 (Outfall 004) in <br />vacuum [tucks. The first load of water was hauled to Pond 12 at approximately 10:00 a.m. on <br />November 16. This process continued until a call was received by Tonya Hammond from the <br />drillers at approximately 6:30 am on Sunday, November 18, stating that the pond was not holding <br />water and the tntcks were then told to discontinue hauling water. On Sunday, November I8, at <br />12:30 pm, Jim Stover, J.E. Stover & Associates, went out to the mine site, observed the situation <br />and collected water samples from the pond which was still dischazging. These water samples <br />were sent to Commercial Testing & Engineering for analysis via UPS Overnight on bfonday, <br />November 19. Resuhs were received via telephone on Monday, November 26, and Total <br />Suspended Solids were reported a[ 79 mgl. <br />
