• • PART I <br />Page 7 of 13 <br />Permit No. CO-0032751 <br />.REDUCE OF COMPLIANCE <br />1. The permittee shall achieve compliance with the effluent ]imitations of <br />Part A, effective July 1, 1977 in accordance with a schedule of <br />compliance approved by the State Water Quality Control Division. <br />The permittee shall submit to the State Water Quality Control Division <br />in less than ninety (90) days after the issuance of this permit, an <br />implementation plan for an abatement program designed to achieve the effluent <br />limitations specified in this permit for discharge from outfall(s) <br />The implementation plan shall consist of an outline of intended design, <br />construction and operation, including a compliance schedule setting forth <br />[he dates by which compliance with the effluent limitations will be reached. <br />The compliance schedule shall include, where appropriate, dates to accomplish <br />the following: <br />(a) completion of preliminary plans <br />(b) completion of final plans <br />(c) award of contract(s) <br />(d) commencement of construction <br />(e) completion of major construction phases <br />(f) completion of all construction <br />(g) attainment of operational level by July I, 1977 <br />Failure to submit a compliance schedule within [he specified time. and/or <br />within sufficient time to allow construction to be completed by this <br />operational date shall be considered a permit violation.` <br />Upon approval of the implementation plan by the Division, the schedule of <br />compliance shalt become conditions of this permit. <br />2. No later than 14 calendar days following a date identified in thc: above <br />schedule of compliance, the permittee shall submit either a report of <br />progress or, in the case of specific actions being required by identified <br />dates, a written notice of compliance or noncompliance, any remedial <br />actions taken, and the probability of meeting the next scheduled requirement. <br />3. A schedule for the elimination of [he discharge, through connection to another <br />treatment system or by other means, may be substituted for this :schedule of <br />upgrading. <br />:t In any case in which a compliance schedule has been timely submi=ted, failure <br />to obtain the Division's approval shall not be considered a vioi:3tion of the <br />permit unless the Division shows that absence of approval or dis.3pproval has <br />resulted from the failure of the permittee to furnish information reasonably <br />required or requested in order to process the compliance schedule:. <br />
