Bretz, Minerals Director <br />Board of Land Commissioners <br />Department of Natural Resources <br />620 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado &0203 <br />Dear Tom: <br />Before the coal lease won today by Mr James Healy at the <br />State Land Board Auction is issued perhaps it would be a <br />good idea to investigate his involvment, with his brother, <br />in the Sunshine Coal mine located about four miles south- <br />west of Aguilar, Colorado. <br />I spoke to Mr. }'ealy about three months ago about a sub-lease, <br />or purchase of State lease 550-13 owned by his Spanish Peaks <br />Construction Company which adjoins the subject lease and is <br />in its sixth year. He said he was not interested in doing <br />anything with it at the present because he was involved with <br />his brother on the other property. He went on to say that <br />last winter was a bad year for coal sales, but the year before <br />was great. <br />Sunshine Coal mine operated for a period of time several years <br />ago under state permit number ~6-14. The mine was closed and <br />the bond was forfeited. I understand the bond was insufficient <br />to reclaim the disturbed area. According to Mr. Gregg Squire <br />the mine is now being operated under a two acre disturbed plan <br />which does not require a permit by the Mined Land Reclamation <br />Division of the Colorado Department of Natural Resources. <br />My point is the Sunshine Coal mine is now being operated in <br />violation of the regulations set forth by the Mined Land Rec- <br />lamation Division, see attached letter, and if Mr. James Healy <br />is involved with the operation in any way he should not be all- <br />owed to bid on any coal lease if an investigation I have asked <br />for proves they are in default. <br />Very truly yours, <br />~~~C/G V Q~cc..c~!/ a.-s <br />William T.
