Prior to construction of the underdrain system for the <br />spent shale disposal area, the operator will submit <br />said plan to the Staff Director for review and approval. <br />The underdrain system will be designed, utilizing best <br />O engineering practices, to address the effects of subsidence <br />and siltation on the system during its used and useful <br />life. <br />2. The operator will, prior to major disturbance in the <br />David Gulch area, monitor the quality of significant <br />sources of surface and subsurface waters. The operator <br />o will monitor the net effects of operations in the Davis <br />Gulch area upon surface and subsurface water quality. <br />3. The operator will monitor the quality and quantity of <br />~\~, waters used to moisturize, leach and irrigate the spent <br />'0 shale disposal area. <br />~4. The operator will, "'` - `''~: `~' monitor the quality <br />of any runoff and leachate from the spent shale disposal <br />area. <br />5. The operator will, upon the termination of mining and <br />processing operations at the site, reclaim, maintain or <br />convey the rights in the David Gulch or Middle Fork <br />dams. The operator will notify the Staff Director of <br />its decision prior to taking action in this regard. <br />In the event that the operator chooses to maintain the <br />\~ dams, operating and maintenance plans for these facilities <br />`ll\' will be submitted to the Staff Director for review. <br />`ll If either or both of these facilities is sold or otherwise <br />conveyed to a third party, that is not an owner in interest <br />of the operation, the operator will provide the Staff <br />Director with the identity of the transferee or purchaser <br />and a summary of the terms of the transfer or sale. <br />If reclamation is to be undertaken, the operator will <br />submit a plan for said action which describes the manner <br />and method of soil and sediment removal, revegetation, <br />reconstruction of the original stream channel and a <br />depiction of the post-reclamation topography. <br />6.
