Counsel for Plaintiffs made a reasonable effort to contact Counsel for the <br />Defendant and to provide an opportunity for the Defendant to be heard in <br />response to Central's claims. <br />9. Based upon the pleadings and evidence to date, the Cou+t concludes that <br />Central is likely to succeed on the merits of the case- <br />10. Aggregate shall immediately provide Central 7 af.s. of fully consumable water at <br />the Brighton Weil Field, or at some other point on the South Platte River <br />agreeable to the parties. Said delivery shall continue without irn:erruption through ,,, <br />September 15, 2002, and thereafter yearly June 1- September 15, according to <br />the terms of the Amended Agreement. For the purposes of this order, water shall <br />nat be Yutly consumable° or at a proper location unless deemed so by the Office <br />of State Engineer, and credited to Centraf's plan. <br />11. In the event Aggregate cannot provide Central ? c.f.s. of fully consumable water <br />at the Weil field, then Aggregate shall cease all dewatering until such time as this <br />obligation is met. <br />12.
