The pit is operated by Aggregate <br />Industries. <br />The Groundwater Management Subdistrict of the Central Colorado Water Conservancy District <br />has operated a Wellfield at this location for augmentation of irrigation wells. We call this our <br />"Brighton Wellfield" and it contains a battery of six wells and pumps, approximately one mile of <br />cement-lined ditch, and electrical supply. About 15 years ago we were approached by the owner <br />of the property regarding gravel mining plans- We expressed concern over the effect of mining <br />on our wells, and entered into sporadic negotiations for approximately five years. In 1990, the <br />Weld County Commissioners approved the county mining permit with the contingency that the <br />mining company obtain an agreement with Central to protect our Brighton Wellfield. It took <br />another 10 years, but finally the Agreement was ratified in 2001. <br />We ran into trouble this spring as this was the first year the agreement was fully in effect. Water <br />was to be provided to Central on June 151, in the amount of 7 cfs offully-consumable water. We <br />did not receive this water from Aggregate Industries, and were forced to file a restraining order <br />against Aggregate on June 17`". A hearing was held in Weld County District Court on June 21st, <br />and Judge Hays ruled in Centrat's favor. (Ruling is attached.) <br />We have been working with Aggregate Industries to acquire the 7 cfs offully-consumable water, <br />but are currently only receiving 5 cfs. This shortage is being replaced with other augmentation <br />water supplies that we currently own, but could result in a shortfall of augmentation water later <br />this fall. This is a serious situation and could result in Central's 960+ member wells being shut <br />off by the State Engineer in the future. <br />,-~ - - <br />
