Long <br />Divnlnn Dimcurt <br />We have reviewed your letter regarding the designation of a spoils spring as a point source <br />discharge as defined in the above mentioned discharge permit. We have also reviewed the <br />correspondence of Mr. Jon Kubic (Water Quality Control Division) and Mr. Wayne Erickson <br />(P&M) which also discussed this subject. We (CDMG) offer the following comments on this <br />matter. <br />CDMG has stated that spoils springs are discharges that, due to mining, have come into contact <br />with minerals that they would not otherwise have come into contact with. We do consider that <br />Outfal1006 at the Edna Mine is a spoils spring, since it has developed in saturated spoils generated <br />from pre-law mining at the Edna Mine. <br />CDMG does not have an opinion nor are we authorized to decide, for the purposes of permits <br />issued by the Colorado Department of Health (CDOH), whether this spring should be considered <br />a point source discharge. <br />The CDOH, in correspondence dated January 6, 1994, advised P&M to direct concerns regarding <br />monitoring of this spoils spring to us (CDMG). Again, we are not authorized to determine <br />monitoring requirements for CDOH permits.
