ITI. ISSUES <br />Presentations to the Board shall be limited to the following issues. The parties shall limit <br />presentations to the question of whether the pending application should be approved or denied, <br />based on the issues stated below. <br />1. Is the application adequate to determine if the surface and ground water systems will be <br />affected and to determine potential impacts to the prevailing hydrologic balance? (Rule <br />6.4.7). <br />2. Has the Applicant proposed adequate measures to minimize disturbances to groundwater and <br />surface water as well as the hydrologic balance of the affected land and surrounding azea? <br />(Rule 3.1.6(1)) <br />3. Has the Applicant proposed an earthem dam? (Rule 3.1.6(2)) <br />4. Has the Applicant proposed measures to effectively control erosion? (Rule 3.1.6(3)) <br />5. Has the Applicant determined whether there will be an impact to ground water quality and if <br />so, have the requirements of Rule 3.1.7 been met? <br />6. Has the Applicant proposed a plan to protect topsoil that satisfies the requirements of Rule <br />3.1.9 and 6.4.5(2)(d)? <br />7. Will the proposed reclamation plan acheive the fmal land use of cropland? (Rule 3.1.1) <br />8. Does the Applicant's proposed reclamation plan describe the type of reclamation it plans to <br />acheive, why it was chosen, the acreage to be reclaimed; and the methods and mechanics of <br />earthmoving? (Rule 6.4.5(2)(a)) <br />9. Has the Applicant proposed a grading plan that will create a fmal topography that is <br />appropriate to the fmal land use of cropland? (Rules 3.1.5 and 6.4.6) <br />10. Has the Applicant proposed a backfilling and grading plan with reasonable timetables that is <br />consistent with good mining and reclamation procedures? (Rule 3.1.5(4)) <br />11. Has the Applicant proposed a plan to handle and dispose of refuse in a manner that will <br />control unsightliness ? (Rule 3.1.5(5)) <br />12. Is the proposed financial warranty amount set at a level which reflects the estimated cost of <br />completing the reclamation plan? (Rules 4.2.1 and 6.4.12) <br />13. Has the Applicant adequately addressed the requirements of: <br />Rule 6.4.8 - Wildlife Information <br />Rule 6.4.10 - Vegetation Information <br />Rule 6.4.I 1 - Climate <br />14. Has the Applicant provided an adequate description to satisfy the seeding and fertilization <br />requirements of Rule 6.4.5(2)(f)(ii) and (iii)? <br />15. Has the Applicant addressed secondary containment for hazazdous materials and/or waste? <br />(Rule 3.1.5(11)) <br />IV. WITNESSES AND EXHIBITS <br />Pursuant to Construction Materials Rule 2.6(2), all parties must exchange witness and exhibits <br />information as set forth below no later than 5:00 p.m. on October 8, 2003. <br />Parties must make a list identifying all witnesses that each may call to testify during the hearing. <br />Identify each witness byname, address, phone number, area of expertise (if any) and subject(s) of <br />Page 3 of 7 <br />
