Violation 99-03-02: Seeded all or portions of several fields perpendicular to the • contour. Action: 1) Repairing the erosion feature in the SE comer of field 2991 using WECo's standard maintenance procedures; 2) inter-seeding all affected slopes on the contour suing the following method 1 band of 2 drill widths inter-seeded on the contour with approximately 6 drill widths between the inter-seeded bands; and 3) submitting to the Department a minor revision request detailing alternate methods of seeding. Montana, Rosebud Mine, Permit MSHA ID 24-01747 August 18, 2000 Regulatory Agency: Montana Department of Environmental Quality Violation 00-03-01: The following deficiencies were identified in the 1999 Annual Hydrology Report: a) no water level data were collected or reported for the four quarters of the report year from 25 ground water montoring sites; b) no water level data were collected or reported for one to three quarters of the report year from the additiona167 ground water monitoring sites; c) water quality samples were not collected or reported from one ground water monitoring site (VVI-181); and the following from the 2000 semi- annual report: failure to collect water level data from 12 ground water monitoring sites. • Action; a) Collecting and analyzing water quality samples from ground water monitoring well WI-181 for the constituents defined in the permit (HRDV); b) obtaining appropriate equipment to facilitate ground water monitoring activities outlined in approved permits (i.e. water level monitoring probe for wells completed to maximum anticipated well depth); c) no abatement is possible to acquire the irretrievable water level measurements lost, however, to abate future problems, WECo must develop and submit to the Department for approval a quality assurance and quality control (QA/QC) plan that ensures that the approved monitoring plan and schedule is adhered to, and that data errors or omissions are minimized in future annual and semFannual hydrology submittals. Additionally, WECo is hereby ordered to abate the above referenced violation by: conducting all future ground water monitoring in compliance with approved permits.
