("OMI") submitted a request in the form of a letter dated October 22, <br />1998 (see copy attached) to allow for the temporary discharge of water from test <br />pumping three planned dewatering wells, as well as for permanent mine water <br />discharge. As a result, the Colorado Water Quality Control Division issued ashort-term <br />certification for a CDPS Industrial General Minimal Discharge Permit No. COG-600000, <br />Facility Number COG-600177. The permit was effective January 08, 1999 and expired <br />April 08, 1999. Due to the spontaneous combustion event that took place in the <br />Sanborn Creek Mine in late January, OMI was not able to complete the dewatering <br />wells, nor the pump tests during the effective term of the permit. OMI now wishes to <br />complete the wells and pump tests and requests that another short-term be issued for <br />this temporary discharge. <br />OMI submitted a separate application dated July 22, 1999 to add a new, permanent <br />discharge point to its existing CDPS Permit No. CO-0000132, for the discharge of mine <br />water from the dewatering wells and/or portals of OMI's proposed Elk Creek Mine. OMI <br />appreciates your continued attention to that application, but would like to clarify that <br />approval of this new outtall is not projected to be needed until after the first of the new <br />year. However, approval of the short-term certification would be appreciated as soon as <br />possible, so that the drilling and pump tests can be completed. <br />Please refer to the October 1998 letter and attachments for information supporting this <br />application.
