Depth of the well permitted to Daryl Billings. According to records of the Division of Water
Resources, this well (Permit No. 140670) was proposed for a depth of 180 feet. Based on the
inquiry of a neighboring mining operation, the Applicant believes that the completed depth of this
well is close to 600 feet. (The Applicant asks the Division what documentation of this depth is
needed and appropriate.)
2. Payment of Water Bills. As part of a mitigation plan, the Applicant will pay the water bills (from
the South Adams County Water and Sanitation District) of any shallow well user along 124'h
Avenue, north of the site, if the capacity of his/her shallow well is adversely impacted by mining
activity. The Applicant understands that such wells are now used for lawns and other non-
domestic purposes, and that the users also receive water from the District for domestic purposes.
The Applicant's intent is to pay the users' entire water bill from the District until reclamation steps
are completed. The Applicant expects that water use would be reasonable -for typical, on-site
use, and would not pay a bill, if water was used off-site and/or for purposes not typical for that
user.
3. Mitigation Agreement with the Henderson Water Ski Club. The Applicant expects to finalize a
formal agreement with the Henderson Water Ski Club, outlining mitigative steps to be
implemented, if mining and/or reclamation activity causes the surface elevation of the ski lake to
decrease. This agreement will be submitted to the DMG; or if it is not finalized before the
permitting process has been completed, it will be submitted to the DMG in the form of a Technical
Revision to the permit.
If you have questions, please call me or Les Ewegen at 303-667-1666. Thanks again for your attention to
this project.
Very T ly Yours,
Scott Keen
Cc: Les Ewegen
File - 1029
