Coors did acquire both the coal and uranium lease rights in Section 36 to preclude any
possibility of conflict or interference from outside interests in conducting its coal
extraction program. In subsequent coal test drilling programs, no significant
radioactivity levels were detected in gamma log studies conducted on overburden
strata.
2. Through a Land Exchange Agreement between Coors and the State Board of Land
Commissioners dated September 16, 1993, Coors did receive in mid-1995 the Patent
to the entire surface of Section 36. The State of Colorado retained all minerals. This
Land Exchange Agreement was in lieu of a further extension of the "Other Minerals
Special Use Permit" (Ash Disposal), and makes possible the continued reclamation of
"A" Pit.

4a
