<br />The evaluation for this permit shows that the Water Quality Control Commission, during their proceedings to adopt the
<br />Classifications and Numeric Standards for Lower Colorado River Basin, considered economic reasonableness.
<br />Fusthermore, this is not a new discharger and no new information has been presented regarding the class cations and
<br />standards. Therefore, the water qualirystandard-based effluent limitations of this permil are determined to be
<br />reasonably related to the economic, environmental, public health and energy impacts to the public and affected persons
<br />and are in furtherance of the policies set forth in Sections 25-8-102 and 104. If the permittee disagrees with this finding,
<br />pursuant to 61.11(b)(ii) of the Colorado Discharge Permit System Regulations, the permittee should submit all pertinent
<br />information to the Division during the public notice period.
<br />B. Monitoring
<br />1. Effluent Monitoring: Effluent monitoring wil! be required as shown in Tables VI-4 and VI-5. Refer to the permit far
<br />locations of monitoring points.

<br />Monitoring requirements are based on the previous permit.
<br />2. Additional MonitorinP: As described in section VLA.2.d.i., a 12-time analysis for total recoverable (TR) arsenic,
<br />potentially dissolved (PD) cadmium, TR trivalent chromium, PD copper, TR iron, PD lead, PD manganese, total
<br />mercury, PD nickel, PD selenium, PD silver, and PD zirsc, is needed for ou all 002. The first sampling shall occur
<br />during the first month after the permit becomes effective (or upon commencement of discharge) and sampling shall
<br />continue for the next eleven consecutive months. If no discharge occurs during the month, sampling shall resume when
<br />discharge resumes and continue until twelve samples have been collected and analyzed using approved methods with
<br />method detection limits as low or lower than those specified in Part LE.3. of the permit.
<br />C. Reporting
<br />1. Discharge MonttorinP Report: Central Appalachia Mining, LLC shall submit Discharge Monitoring Reports (DMRs) on
<br />a monthly basis to the Division. The Division now requires all permittees to submit DMRs monthly. These reports shall
