Box 191 <br />victor, CO 80860 <br />RE: Discussions Held Regarding Commitments (9)29, (10)30, 11(31), and <br />16(36) <br />Dear Mr. Hardaway: <br />On May 30, 1995 a meeting was held at the Division to resolve some ambiguity in <br />the language of commitments 9(29), (10)30, 11(31), and 16(36). Present at the <br />meeting were yourself, Mr. Jim Komadina, and Bob Micassik from Cripple Creek <br />and Victor Gold Mining Company. Mr. Berhan Keffelew, Mr. Michael Long, <br />Mr. Bruce Humphries, Dr. James Pendleton, Dr. James Stevens, and <br />Dr. Harry Posey were present from the Division. <br />The discussion concentrated on how to properly define what will determine a <br />loss of containment of the leach pad facility by the Division which is agreeable <br />to the operator based on some numeral standard. <br />When the permit amendment was approved in April of 1994, the Division agreed <br />to allow the placement of the iron clad clay liner in the amendment area with <br />.5 mg/1 of WAD cyanide. <br />It was agreed upon by the Division and the operator that a trend that shows <br />.5 mg/I exceedence in association with the volume of solution above baseline <br />and a rise in pH above baseline should be used as an indicator of leach pad <br />facility loss of containment. For e.g., a cyanide concentration in the LDS sumps <br />that is in excess of the allowable concentration (.5 mg/U does not necessarily <br />mean a loss of containment and that a response by the operator is warranted. <br />In order to trigger a response, the pH and the allowable leakage rates will also <br />have to exceed baseline levels or rates. <br />The Division and the operator's representative agreed to collect baseline water <br />quality information, which at a minimum; must include the following <br />parameters: <br />1. pH <br />2. WAD cyanide <br />3. Free cyanide <br />
