Mr. Forrest Leaf <br />March 1, 2004 <br />Page 2 <br />The proposed source of replacement for this pit is fully consumable Metro Wastewater <br />Treatment Plant (WWTP) effluent from a lease with the Consolidated Mutual Water Company <br />(CMWC). The Metro WWTP is located approximately 20 miles upstream of this aggregate <br />operation. A 0.25 percent transit loss per mile (5.0 percent overall loss) has been accounted <br />for in the replacement schedule totaling 21.27 acre-feet during the year this plan is in place. <br />A monthly breakdown of depletions and replacements is shown in the attached Table No. <br />2 that was submitted with your report. <br />I approve the proposed substitute water supply plan in accordance with Section §37-90- <br />137(11), C.R.S., subject to the following conditions: <br />This plan shall be valid through December 31, 2004, unless otherwise revoked or <br />modified. <br />2. If this plan will not be made absolute by a water court action by the plan's expiration <br />date, a renewal request must be submitted to this office with the statutory fee <br />(currently $217) at least 45 days prior to the expiration date of this plan. <br />3. Water that is tributary to the stream system is trapped within the boundaries of the slurry <br />wall. This trapped water must be dewatered back to the stream system without <br />consumption. Any water consumed from within the boundaries of the liner must be <br />replaced, except for the water retained iri the product. <br />4. The losses associated with this mining operation must not exceed a total of 20.2 acre- <br />feet for the duration of this plan approval. These losses include 10.75 acre-feet of <br />evaporation from the proposed exposure of 3.66 acres of groundwater, 3.31 acre-feet <br />of water used for dust suppression and 6.14 acre-feet of water used in concrete <br />hatching due to 40,000 cubic yards of concrete production. Should the lagged annual <br />depletions to the South Platte River exceed 20.2 acre-feet from this pit prior to the <br />expiration date of this plan, an amendment will need to be filed with this office. <br />5. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. <br />6. All pumping shall be measured in a manner acceptable to the Division Engineer. <br />7. The water commissioner responsible for the administration of this plan is Mr. Robert <br />Stahl, 9378 WCR 25, Fort Lupton, CO 80621, phone no. (303) 857-0742. The <br />applicant shall maintain daily records of all diversions, replacements, and the amount <br />of water used for each particular use. The applicant shall provide a report of these <br />records to the division engineer and the water commissioner on a monthly basis on a <br />form approved by them. The accounting must be submitted within five (5) calendar <br />days of the end of the month for which the accounting is being made. <br />In addition, the applicant shall submit a report from the entity making replacements; <br />for this plan, that entity is Consolidated Mutual Water Company (Consolidated). The <br />report shall include an accounting of all of the Denver Metro wastewater plant water <br />effluent controlled by Consolidated, showing the total volume of water under its control <br />
