MINERALS COMPANY, LLC <br />COAL RIDGE NO. 1 MINE <br />IMPOUNDMENT YEARLY INSPECTION <br />In accordance with Rule 4.05.9(14), all impoundments shall be inspected at least yearly <br />to determine if the impoundment has been maintained as designed, and in accordance <br />with the approved plan and the applicable regulations. This yearly inspection is for the <br />impoundment located at the Coal Ridge No. 1 Mine. <br />On April 7, 2006, I performed the required yearly inspection. I, J. E. Stover, have a <br />wide variety experience in the design and construction of earth fill embankments. <br />Nothing was observed during the inspection that would indicate the pond has a <br />-- potential for failure: There was no appearance of erosion, instability, structural <br />weakness or other hazardous conditions. There are no required monitoring procedures <br />or instrumentation other than quarterly and yearly inspections. There are no aspects <br />which might affect stability and there is no required maintenance. The west cell had <br />water standing approximately 6 inches below the invert of the primary spillway at <br />approximate elevation 5589. The east cell had a small pool of water in the northwest <br />comer at approximate elevation 5587 <br />The sediment pond has the following capacity: <br />IMPOUNDMENT CAPACITIES -ACRE FEET <br /> Water Sediment Total <br />Sediment Pond 6.34 0.90 7.24 <br />Note: <br />Capacities are derived from Figure 4.3-6, Issue No. 1 dated 7/27/00 and <br />verification of sediment level relative to primary spillway. <br />To the best of my knowledge and belief, the impoundment has been maintained as <br />designed and in accordance with the approved plan and applicable regulations. <br />Date <br />
