("OMI") submitted a request in the form of a letter dated October 20, <br />1998, to modify CDPS Permit No. CO-0000132 to authorize pumping and discharge of <br />water from OMI's proposed Elk Creek Mine D-seam portals and initial entries during <br />construction, as well as long-term dewatering of the D-seam during normal operation of <br />the new mine. Dewatering of the D-seam construction area would be accomplished <br />through three (3) planned dewatering wells. The long-term dewatering of the D-seam in <br />the Elk Creek Mine would be accomplished by pumping mine water from in-mine sumps <br />to the surface and to a common, combined discharge point with the dewatering wells. <br />This discharge point would be similar to and in addition to existing Outfall #011 for the <br />Sanborn Creek Mine water discharge. <br />As a result of the October 1998 request, the Water Quality Control Division ("WQCD") <br />issued ashort-term certification to OMI on January 08, 1999, for a CDPS Industrial <br />General Minimal Discharge Permit (Permit No. COG-600000 for Facility No. COG- <br />600177). Due to the spontaneous combustion event in the Sanborn Creek Mine that <br />lead to the sealing of the mine in late January, that certification expired on April 08, <br />1999, without OMI ever discharging. <br />Nonetheless; OMI is requesting a new mine water discharge point to CDPS Permit No. <br />CO-0000132, rather than renewal of the short-term certification. Please refer to the <br />October 1998 letter and attachments for information supporting this application.
