PART I <br />Page No. 3 <br />Permit No. COG-850000 <br />A. COVERAGE UNDER THIS PERMIT <br />1. This general permit authorizts discharges that consist entirely or principally of precipitation-induced surface runoff from <br />coal mining and processing operations including loadouts, while active mining is oaurring or doting reclamatioQ prier to <br />final bond release, in[o waters of the State of Colorado. [f additional sources which the Division determines to be minor <br />in nature such az selected mine waer, preparation plant water, spoils spring water or other wastewater may be <br />discharged, these sotuus may be covered under this pcrmit az the Division's discretion providing that such wastewater <br />would not require effluent limitations and/or monitoring requirements other than those contained in this permit. Such <br />determinations will be made on a case-by case bazis upon review of the permit application and any additional relevant <br />information. If discharge from one or more of the above listed sources require additional limitations and/or monitoring <br />requirements, an individual permit may be required. Multiple ducharge points from one facility may be authorized <br />through this permit providing al! meet these criteria. <br />2. In order to apply for certification under this general permit, the owner, operuor, and/or authorized agent of the subjec[ <br />facility shall submit by certified mail or hand delivery, the completed Coal Mining Waztewuer Discharge Application <br />(furnished by the Division) which generally requires the following information (u a minimum): <br />a. Name, address, and descriptive location of the facility; <br />b. Name of principal in charge of operation of the facility; <br />c. Name of immedia[e receiving waters, (including irrigation ditches, intemilttent streams and dry drainage, az <br />applicable); <br />d. Description of the [ype of activiry(ies) resulting in the discharge, including the anticipated duration of the activity <br />and/or the discharge, anticipated volume and tale of discharge, and the source(s) of water to be discharged; <br />e. Description of any waztewater rrr~rm~^t system(s) and recyde/reuse u[ilirtd; <br />f. A topographic 8Yt x l l inch map showing the general geographical location of the facility and any nearby landfills, <br />mine or trill tailings, or any other known or suspected sources of pollutants; <br />g. An 8Yt z 11 inch sketch of the facility showing all structures, outfalls and receiving waters, az well az storage <br />locations of any petroleum or chemicals on site; and <br />h. A chemical analysis of the water to be discharged. If no warer is available, this shall be indicated. <br />if the discharge is to a storm sewer system, ditch or other manmade convryance, approval from the owner of the system <br />must be obtained prior to discharge. <br />A[ least 30 days prior to the anticipated due of discharge, such information shall be submitted on the application form <br />to: <br />Colorado Department of Public Health and Environmem <br />WQCD-PE-B2 <br />4300 Cherry Creek Drive South <br />Denver. CO 80222-1530 <br />The Division shall have up to thirty days after receipt of the above information to request additional data or dewy the <br />authorvation to discharge. Upon receipt of additional information, the Division shall have an additional 30 days to issue <br />or deny authorization to discharge. If the applicant does not receive a request for additional information or a notification <br />of denial from the Division within thirty days, authorization to discharge in accordance with the terms and conditions of <br />the permit shall be deemed granted. <br />If the Division determines that a new facility does not fall under the authority of the general permit, then the information <br />received will be processed for an individual permit and discharge will not be allowed until 180 days after the daze the <br />application waz received. The applicant shall be notified of such a detnmin~!~on. If during the renewal process, the <br />Division determines that a facility no longer qualifies for the general permit, the facility will be allowed to discharge <br />under the general permit until an individual permit is issued. <br />3. Author'vation to discharge under this general permit shall expire on June 30. 2002. The Division must evaluate this <br />general permit once every five years and must also recertify all applicants' authority to discharge under the general <br />permit u such time. Therefore, a permittee desiring continued coverage under the general permit must reapply by <br />Jannarv 1. 2002. The Division will determine if the applicant continues to operate under terms of the general permit. <br />
