CF&I subject to Lessee's license to use such water on the Prem- <br />ises only duriny the term of this Lease in connection with its <br />mining operations on tl~e Premises. <br />(b) If at any time Lessee considers abandonment of <br />any water rights used or acquired by Lessee pursuant hereto, <br />Lessee shall first notify CP&I of such intent and shall allow <br />CFrii 90 days, in which to determine whether it agrees that such <br />water rights should be abandoned. Lessee agrees not to abandon <br />any such rights if CFa+I determines such rights should be re- <br />tained. <br />(c) Nothing contained herein shall be construed to <br />prevent CF4I from developing or using water for its own pur- <br />poses on or off tk~e Premises in a manner that does not inter- <br />fere with Lessee's operations. <br />7.7 Labor and Materials. Lessee shall provide and <br />promptly pay for all of its labor, materials and other sums <br />relating to third-party contractiny services on the Premises. <br />Lessee agrees to indemnify CF6I and agrees to }gold CFbI free <br />and harmless from any claim, charge, cause of action or damage <br />based upon or arising out of or in connection with Lessee's ~ <br />acts hereunder, in regard to the furnishing of labor and the <br />acquisition of materials and supplies. <br />7.8 Taxes. Duriny the term of this Lease, Lessee, and not <br />CFI, shall pay when due all general ad valorem and property <br />taxes to the extent such taxes exceed the taxes assessed <br />against the Premises for 1982. Lessee shall pay all other law- <br />ful public taxes and assessments, whether general, specific, or <br />otherwise, assessed and levied upon or against the Premises or <br />production therefrom, or attributable to Lessee's operations <br />hereunder, or upon any property or improvements placed by Les- <br />see on the Premises for its own use, including all severance <br />taxes; provided, however, that CF6I shall pay any income tax <br />levied on any Loyalties paid to it by Lessee herein. Lessee <br />shall have the right in good faith to contest a•ny of the above <br />taxes and assessments but shall not permit or suffer the Prem- <br />ises or any part thereof, or any improvements or personal prop- <br />erty thereon, to be sold at any time for such taxes or assess- <br />ments. <br />VIII. SURRENDER RENENAL AND TER1•fINATION <br />B.1 termination by CF6I. CFBI may terminate this Lease, <br />in the event of default by Lessee, as set forth in Section X <br />below. <br />8.2 Renewal of Lease. CFSI expressly reserves the right <br />reasonably to readjust and fix royalties payable hereunder and <br />other terms and conditions at the end of the primary term here- <br />of and thereafter at the end of each succeeding ten year period <br />-6- <br />
