Long <br />Division Dneclor <br />SUMMARY AND RESOLUTION OF INTERACTION: I contacted Kathy regarding the <br />2nd quarter TSS exceedences reported by Marr Mine on their DMR's. My question was what <br />actions needed to be taken. She said that Kerr Coal requested a storm exemption since the <br />discharge was due to runoff from snow melt. I requested to be copied on that request. She <br />said that if it is due to snowmelt they probably won't take action unless they show repeated <br />history over several quarters or consistently periodically every year. I.E every year at the <br />same time. I gave her some history of the mine. Final backfill of Pit 1 in 1995, topsoiled and <br />seeded with a cover crop in Fall 1995. So the pit 1 area was essentially bare this year. Rye <br />only sprouting this spring '96. I also confirmed that they have very clayey soils. I mentioned <br />that I had taken samples for settleable solids in May and nothing settled out even after I left <br />one of the samples overnight.
