._ _ <br />- - - <br />c~ ~ y To ~ ~ ~----- III IIII IIIII IIIIIII- <br />LAND RECLAMATION BOARD <br />Department of Natural Resources <br />Room 2:L5, 1845 Shermaa St. Telephone: 892-3401 <br />Denver, Colorado 80203 <br />n... ~_~ a__ G,.,. <br />_ ~- <br />Land Stabilization and Reclamation Agreement <br />THIS AGREEMENT is entered into this day of , ' <br />1973 by and between THE STATE OF COLORADO, by and through its Director of <br />Natural Resources and the Land Reclamation Board (hereinafter referred to <br />C°- <br />as "State") and CL/~YT~'N ~ ~O/,/ C°NS~~VCTION (hereinafter re Eerred to <br />as GLf})/TU/~ ) . <br />W I T N E S S E T H <br />WHEREAS, CGfI~J-U!V desires to operate a SAND ~~•~-i91.'EL <br />mine in <br />~IZAND County, <br />Section, Township, Range, County <br />Colorado, better known as the /ylU!'Pdy C2CoKEDC2EEK PiT' Sf~~; and <br />WHEREAS, C_~,yro iCl has submitted a plan on the Proposed <br />Land Stabilization and Reclamation Procedures for the proposed SAND g GKA!/EL <br />mine operations; and, <br />i C:2ooKL ~ c IL£smK- P/t <br />WHEREAS, Said /t~U,Ef'f/J sr~wQ will be operated for the <br />purpose of extracting S'A,Vb ~ 6~~/i~L for commercial marketing and, <br />WHEREAS, The Colorado Open Mining Land Reclamation Act provides <br />statutory authority for the Land Reclamation Board of the State of Colorado <br />to enter into agreements with operators or persons in charge of mining <br />operations such as those contemplated by CLf3~% O /~ to insure that the <br />necessary stabilization and reclamation work will be done to prevent land- <br />slides, floods or erosion. This section of the law further provides that <br />the Land Reclamation Board requires a performance bond conditioned upon the <br />faithful performance of the stabilization work required by the Board; and, <br />WHEREAS, The Land Reclamation Board has determined that the <br />mining operation to be conducted by CL-~4yT~ N in said Section <br />~Z could have an adverse 'kffect on the environment and could <br />result in landslides or erosion if proper stabilization and recla-~ation <br />procedures are not followed. <br />.a_._:, <br />
