<br /> THIS PFKIIT is issued this 25th day of October, 1979 by the `fined Land
<br /> Reclamation Board, Department of Natural Resources, State of Colorado.
<br /> W I T N E S S E T H : .
<br /> IWFEREAS, ALBERT FREI & SONS , INC . desires to conduct a(n) open pit miring
<br /> operation, known as Frei Pit d3 , for the purpose of extracting open pit
<br /> mined sand & gravel ; and ,
<br /> STPIRE-1S, on September 6 , 19 79 , ALBERT FREI & SONS, INC. "FILED" an
<br /> application,a reclamation plan and map, and the required fee, as required by law; and
<br /> WHER-AS, on October 25 19 79 , the dined Land Reclamation Beard approved
<br /> ALBERT FREI & SONS, INC. application and set bond; and
<br /> WFZRE_aS, on July 22 1980 , t-e )fined Land Reclamation bard accented
<br /> surety submitted by ALBERT FREI & SONS , INC . and such date shay- be. considered the
<br /> date of issuance of the permit and the anniversary date for all other purposes ; and
<br /> WHEREAS, the `lined Land Reclamation Board has made a finding, for the purposes
<br /> of issuing this permit, that:
<br /> 1) the application complies with the requirements of the Coloracc
<br /> `!ined Land Reclamation act and all a001_cable local , state and
<br /> Federal laws; and,
<br /> 2) the operation wi11 not adversely affect the scabiLity of an.•
<br /> significant, valuable, and permanent man-made structures loc._t_d
<br /> within two hundred feet of the affected land, e:.:cept where there
<br /> is an agreement between the operator and the persons having an
<br /> interest in the structure that damage to the structure is to be
<br /> compensated for by the operator; and,
<br /> 3) the proposed mining eper:t_ons and reclamation can be carried cut
<br /> in conformance with the requirements of C.R.S. 1973, 34-32-11_6, as
<br /> amended ( 1976 SeSS . Laws H.B. 1065) ; and
