<br />THIS AGREEMENT, made and entered into this~~ day of
<br />January, 1978, A.D., by and between GLEN 0. and DOROTHY I.
<br />CHAMBERS of Rifle, Colorado, hereinafter called "LESSOR", and
<br />MOUNTAIN MOBILE MIX Inc. of Frisco, Colorado, hereinafter
<br />called "LESSEE".
<br />WITNESSETH THAT: The parties hereto, for and in consider-
<br />ation of the mutual covenants and agreements herein contained,
<br />do hereby agree as follows:
<br />1. The Lessor does hereby grant, demise and lease to the
<br />Lessee for the exclusive and only purpose of exploring for,
<br />mining, removing, crushing, washing and marketing sand and
<br />gravel (aggregate) thereon and therefrom, the following des-
<br />cribed land, situated in the County of Garfield, State of
<br />Colorado, to-wit:
<br />Lot 2 and part of the North it of S.E. ~,; and of the
<br />N.E. i of the S.W. %,,, and of Lot 3, W~1 of S.W. ~,
<br />Section 11; and Lot 1, Section 14, township 6 5,
<br />range 93 W, of the 6th P.M.
<br />The mining operations shall be confined to a 10 acre
<br />tract located in the southwest corner of the above
<br />described property, briefly outlined: Beginning at a
<br />point on the north bank of the Colorado River, 50-ft.
<br />east of the west property line, then due east for
<br />750-f t., along the north bank of the Colorado River,
<br />then due north for 300-ft., then due west for 375-ft.,
<br />then due north for 560-ft., then due west for 375-ft.,
<br />then due south for 860-ft. to the point of beginning.
<br />2. The exact boundary locations will be adjusted and
<br />established by the Lessor and Lessee before commencing the
<br />mining operations.
<br />3. Receipt is hereby acknowledged of ONF. DOLLAR and other
<br />good and valuable considerations as consideration upon the
<br />execution of this ].ease.
<br />4. TO HAVE AND TO HOLD said land for a term of five years
<br />from the date the "Permit Application" has been approved by
<br />the COLORADO MINED LAND RECLAMATION BOARU, and subject to
<br />the terms and conditions herein provided.
