DORSEY & WHITNEY LLP
Division of Minerals and Geology
April 3, 2000
Page 3
housing development planned by Pinnacle. As stated in a report prepared for Pinnacle by its consulting
engineers:
Where unstable slopes are outside of development areas, they may not present a
hazard to structures. However, the steep slopes of the drainage feature may
progressively affect areas within a lateral distance of 1 to 3 times the vertical height of
the banks. Flood events can erode and fail large areas of these slopes, which can
encroach upon future development areas.
Lafarge should provide additional geotechnical information regazding this instability prior to any
approval of the Application.
2. Additional Information Needed.
Pinnacle believes that the Application does not adequately address the requirements of Rule 6.4
because many of the exhibits submitted with the Application are lacking in required information.
Specifically, the following exhibits should be examined for adequacy.
Rule 6.4.1 Exhibit A. Exhibit A to the Application states only that the project is located in "A
portion of the NW 1/4" of the referenced Section ]0, T2S, R67W. This is not a description which is
"wholly adequate for field location of the property" as required by rule 6.4. I.
Rule 6.4.3 Exhibit C. This rule requires maps showing certain details. Pinnacle believes that
there aze concrete irrigation structures (lined ditches) which traverse the affected property and may
impact adjoining lands which are not shown in Exhibit C to the Application or elsewhere. See
Attachment 2.
Rule 6.4.5 Exhibit E. Rule 6.4.5(2) requires that an applicant discuss the post-mining use of the
affected land. Lafarge states that the end use of the lands affected by the Application will be a water
storage reservoir. Pinnacle is concerned that the lack of groundwater studies discussed in section 1
~;~ 1 ~~above create a question as to advisability of using this site for storage of water, or wildlife use, after
{;f' mining is completed. Further, Pinnacle believes that the site will be too small and shallow for any public
yr/'~ ~, /Water supply entity to be interested in using this facility for water storage. The Application does not
I: ~~~
