Colorado 80203 <br />Re: Tanabe Pit Application for Regular (112) Construction Materials Operation <br />Reclamation Permit, File No. M-2000-02 <br />Ladies and Gentlemen: <br />This letter is filed on behalf of our client Pinnacle Pines, LLC ("Pinnacle") in response to the <br />above application ("Application"), within 5 days after the Informal Conference in this matter and <br />pursuant to rule 1.4.6, 2 CCR 407-4 and Section 34-32.5-115(2) Colorado Revised Statutes. Also, <br />enclosed is an executed original Party Status Request Form seeking to have Pinnacle made a formal <br />party to this action. <br />Pinnacle's main concems with the Application are public health and safety. Pinnacle believes <br />[hat [he Application does not provide the information required by the regulations of the Division. <br />Further, Pinnacle is concerned that there have been significant procedural errors in the filing of the <br />Application. Thus, the Application does not meet the minimum requirements of the "Act, Rules and <br />Regulations" per rule 1.4.5 (3). Each of these concems is addressed below: <br />1. Public Health and Safety. <br />A. Groundwater contamination. Pinnacle is [he owner of certain lands immediately east and <br />south of the lands affected by the Application (see Exhibit C). Groundwater studies conducted by <br />Pinnacle's consultants have determined that a plume of materials crosses Pinnacle's property at depth in <br />
