Long <br /> Division Director <br />Re: Eagle 5 & 9 Mines, Permit C-81-044, Permit Renewal RN-03 <br />Item 44 of CDMG's letter of June 9, 1998 <br />Please let me know whether or not you agree with my conclusion at the end of this memo. <br />On October 25, 1999 Rick Mills asked me by phone if it is necessary, as I:he Division requires in <br />Item 44, to submit an as-built certification for the 20-year old pond 9-P1 ,given the original <br />function of the pond as a mine dewatering pond (rather than a sedimentation pond) and given the <br />historical minimal inflows into the pond. <br />I researched the permit application and our files, and found the following information. <br />1. Drawing DWG. N-36 in the permit application shows pond 9-P1 to be the first in a <br />series of four ponds that would have received dischazge from the portals of Mine 9. <br />Active mining of Mine 9 permanently ceased in 1985 and the portals have been sealed. <br />2. Drawing DWG. N-36 serves at least as a minimal as-built certification as it shows <br />minimal design features of pond 9-P1 and bears a PE stamp with signature and a <br />statement "Conswction complete on June, 1979 as per this desie;n'". <br />3. A letter from Cyprus Empire to the Division, dated July 19, 1989 (in our Pond <br />Certifications file) explains that pond 9P-1 was originally part of the Mine 9 dewatering <br />system. <br />4. Cyprus' quarterly pond inspection reports back to 1993 show pond 9-P1 to be a mine <br />dewatering pond. (Older reports are archived.) <br />5. The pond reports show this 6.6 acre-foot pond to have held two feet of water in Spring <br />1994 and Spring 1996, and one foot of water in Spring 1995. It was dry at all other <br />times. <br />6. The pond's drainage area is 36.4 acres (SEDCAD run in Exhibit 18, page 116 of permit <br />application). <br />
