During the month of November 2002, DMP 001 did not <br />discharge. DMP 004 and DMP 007 did not exceed any compliance criteria in November 2002. <br />DMP 004 passed the 4t° quarter 2002 WET tests. However, DMP 007 failed the 4'" <br />quarter WET test for D. magna. WET tests results from the 3rd quarter of 2002 at DMP 007 also <br />failed for D. magna. Subsequent PTI testing identified the cause as total dissolved solids (TDS) <br />caused by calcium sulfate (CASo4). Because the cause of the toxicity has been identified, The <br />Pittsburg & Midway Coal Mining Company (P&M Coal) has requested relief from accelerated <br />testing at DMP 007 in a letter to the Colorado Department of Public Health and Environment <br />dated November 18, 2002 until a full year's worth of data has been collected and evaluated. <br />Results will be submitted with the 2002 Annual Hydrology Report. <br />Please contact me at (307) 742-0031 with any questions or comments you have regarding <br />this matter. <br />December 6, 2002 <br />SL:gh <br />Enclosures <br />File: 99-144 <br />Project Engineer <br />
