During the month of November 2002, DMP 001 did not
discharge. DMP 004 and DMP 007 did not exceed any compliance criteria in November 2002.
DMP 004 passed the 4t° quarter 2002 WET tests. However, DMP 007 failed the 4'"
quarter WET test for D. magna. WET tests results from the 3rd quarter of 2002 at DMP 007 also
failed for D. magna. Subsequent PTI testing identified the cause as total dissolved solids (TDS)
caused by calcium sulfate (CASo4). Because the cause of the toxicity has been identified, The
Pittsburg & Midway Coal Mining Company (P&M Coal) has requested relief from accelerated
testing at DMP 007 in a letter to the Colorado Department of Public Health and Environment
dated November 18, 2002 until a full year's worth of data has been collected and evaluated.
Results will be submitted with the 2002 Annual Hydrology Report.
Please contact me at (307) 742-0031 with any questions or comments you have regarding
this matter.
December 6, 2002
SL:gh
Enclosures
File: 99-144
Project Engineer
