Neighbors for a Desirable Park County, lnc., pursuant to said Contract, has an interest in <br />the reserved mineral interests with respect to a portion of the Cargill Ranch, to wit: The <br />S)/ %, SW '/. of Section 11, and the NW '/< of Section 14, all in Township l0 South, <br />Range 77 West of the 5`" P.M., in Park County, Colorado. <br />4. The reservation of "other minerals" contained in said Warranty Deed includes and applies <br />to gold and other heavy metals, and also includes and applies to sand and gravel <br />contained on said premises. In partial support of this allegation, see the Affidavit of <br />Robert Cargill, incorporated herein and attached hereto as Exhibit B. <br />5. Defendants, the heirs and/or devisees of N.C. Cargill and/or Lora E. Cargill, may claim <br />an interest in and to the mineral interests in the real property which is the subject matter <br />of this action by virtue of the reservation of one-half of all the oil, gaa, and other minerals <br />contained in that Warranty Deed recorded on duly 15, 1963 at Book 180, Page 135, of the <br />Park County Records. <br />6. Defendants, Jack R. Allen and Susanne R. Allen., may claim an interest in and to the <br />mineral interests in the real property which is the subject matter of this action by virtue of <br />a Warranty heed recorded on March 7, 2005 under Reception No. 610775, (and 610777), <br />of the Park County records. <br />7. Defendant, Park County, may claim an interest in and to the mineral interests in the real <br />property which is the subject matter of this action by virtue of a Warranty Deed recorded <br />on November 1, 1982 at Book 346, Page 487 of the Park County records. <br />8. Defendant, $ruce R. Plankinton, may claim an interest in and to the mineral interests in <br />the real property which is the subject matter of this action by virtue of a Warranty Deed <br />recorded on August 17, 2001 under Reception No. 549961 of the Park County records. <br />9. Defendant, Plankinton Family Limited Partnership, may claim an intcrest in and to the <br />mineral interests in the real property which is the subject matter of Phis action by virtue of <br />a Warranty Deed recorded on October 26, 1998 under Reccption No. 497225 of the Park <br />County records, and by virtue of the Deed recorded on March 7, 2005 under Reception <br />No. 610774. <br />]0. Defendant, River Ranch Restoration Company, LT.C, may clam an interest in and to the <br />mineral interests in the real property which is the subject matter of this action by virtue of <br />a Warranty Deed recorded on June 30, 2004 under Reception No. 601249. <br />
