Ms. Trumbly and Mr. Holder
July 22, 1988
Page 2
of owners of recreation land - see especially HB 1399 (1988)
which puts a dollar limit on such liability; and SB 69 (1988)
which amends section 24-30-1510 to allow the state to indemnify
a "lessor." Both Betsy Clark, legislative liaison for the
Division of Wildlife, and Bill Miller, the State Risk Manager,
advise the intent of SB 69 is to include easements as well as
leases. My legal assistant Penelope Woodward will review the
legislativ e history while I'm gone to see if it will support such
an interpretation.
Finally, I've enclosed copies for Ms. Trumbly of a contract
for another conservation (public fishing) easement between the
Division and the Red Mountain Ranch Partnership and a deed for
such an easement from Marvin Leeper.
Hopefully, we can pursue further negotiations when I return.
Thank you.
Sincerely,
FOR THE ATTORNEY GENERAL
/:
/ G(hw
c/ awre A.
