Submission of Incorrect or Incomplete Information <br />SJhere the permittee failed to submit any relevant facts is a per sit <br />application, ar submitted incorrect information is a permit application <br />or report to the Division, t'.:e persittee shall promptly submit the <br />relevant application iafo:-matioa which was not submited or any <br />additional information needed to correct any erroneous information <br />previously submitted. <br />5. B~ss_ <br />1) Bypass Ss prohibited, and the Division may take enforcement action <br />against a permlttee for bypass, unless: <br />a) The bypass did not cause effluent limitations Co be ezceeded <br />and vas for essential maintenance to assure efficient operation; <br />b) Bypass vas unavoidable to prevent loss of life, personal <br />Injury, or severe property damage; <br />c) There were ao feasible alternatives to the bypass, such as the <br />use of auziliary treatment faelllties, retention of untreated <br />vaetee, or maintenance during normal periods of equipment <br />downtime. This condition Ss not satisfied if the permittee <br />could have installed adequate backup equipment to prevent a <br />bypass which occurred during normal periods of equipment <br />dowtime or preventative maintenance; and <br />d) The permittee submitted notices as required is "Bypass <br />Notification", Part II.A.6. <br />6. Bypass Notification <br />If the permittee knows Sa advance of the need for a bypass, a notice <br />shall be submitted, at least ten days before the date of the bypass, to <br />the Division and the Environmental Protection Agency (EPA).
