Change in Discharge <br />The permlttee shall inform the Division (Permits and Enforcement <br />Section) Sa rritiag of nay intent to construct, install, or alter nay <br />process, facility, or activity that is likely to result is a new or <br />altered discharge and shall furnish the Division such plans and <br />specifications rhich toe Division deems reasonably necessary to <br />evaluate the effect on the discharge sad receiving stream. <br />The permittee shall submit this notice rithia two (2) reeks after <br />making a determination to perform the type of activity referred to In <br />the preceding paragraph. Process modifications include, but are not <br />limited to, the introduction of any new pollutant not previously <br />identified la the permit, or any other modifications which may result <br />is a discharge of a quantity or quality different from that xhich was <br />applied for. Folloring such notice, the petmittee shall be required to <br />submit a ner CDPS application and the permit may be modified to specify <br />and limit any pollutants not previously limited, Sf the new or altered <br />discharge might be inconsistent rith the conditions of the ezisting <br />permit. In no case shall the permictee implement such change xithout <br />first notifying the Division. <br />2. Special Notifications - Definitions <br />a) Bypass: The intentional diversion of caste streams from any <br />portion of a treatment faculty. <br />b) Severe Property Damage: Substantial physical damage to property at <br />the treatment facilities xhich causes them to become inoperable, or <br />aubataatial and permanent lose of natural resources which can <br />reasonably be ezpected to occur is the absence of a bypass. It <br />does not mesa economic loss caused by delays Sa production. <br />c) Spill: An unintentional release of solid or liquid material rhlch <br />may cause pollution of state xaters. <br />d) Qpaet: Aa ezceptional incident is rhich there Ss unintentional and <br />temporary noncompliance rith permit effluent limitations because of <br />factors beyond the reasonable control of the permittee. An upset <br />does not include noncompliance to the eztent caused by operational <br />error, improperly designed treatment facilities, inadequate <br />treatment facilities, lack of preventive maintenance, or careless <br />or improper operation. <br />Code: ,i - 24 Date: 1 - 84 <br /> <br />
