Page 2 • • <br />December 26, 1991 <br />Bonding issue <br />M-73-007; M-77-213 <br />The above describes what transpired according to our recollection and <br />notes, and, in our opinion, ref lecte the moat accurate description of <br />the agreement. My client, Transit Mix Concrete, after being informed of <br />the agreement (that the additional bond amount would be approximately <br />$800,000 depending on the actual disturbed acreage) discussed the matter <br />with their parent company, Continental Materials in Chicago. <br />Continental informed Transit Mix that acquiring that much additional <br />bond was not possible. On December 23, 1991 Mr. Bud Herskind, President <br />of Transit Mix Concrete, discussed the matter with Bruce Humphries, <br />informed him of the same, and explained why the additional bond was not <br />available. I briefly discussed the matter with Bruce Humphries on <br />December 20, 1991, but did not discuss the reasons ae I was not aware of <br />the nature of the problems at the time, only that there was a problem. <br />On December 23, 1991 Mr. Herskind and I toured the site and discussed <br />the possibilities of reducing the amount of major disturbance (as <br />defined in your rules) and placing as much land as possible in the minor <br />disturbance category as quickly as possible. This would effectively <br />reduce the amount of bond needed to reclaim the existing disturbances <br />because only a fraction of the $5,000 per acre being applied under the <br />December 19, 1991 figure would be needed to bond land in a major <br />disturbance category. This disturbance reduction program was explained <br />to Mr. Humphries by Mr. Herskind in their telephone conversation on <br />December 23, 1991. <br />The result of these discussions and reconsiderations is two fold. <br />First, the information required in your November 1, 1991 letter will be <br />supplied as quickly ae possible. This morning we discussed each item in <br />that letter and agreed to the exact meaning and expectation of each <br />item. Later this morning you were informed, through your voice mail, <br />that Transit Mix had authorized the release of the digitized map data <br />from Leigh Whitehead & Associates (to be supplied on 1.y1, Mbyte 3.5" <br />floppy disk in non-compressed Autocad version 11 format). The point <br />data should be delivered on the morning of December 30, 1991. Other <br />information listed in your November 1, 1991 letter will be supplied as <br />soon as the information can be assembled. <br />Second, the disturbance reduction program will be implemented starting <br />on December 30, 1991 and will continue until completed. Although exact <br />acreages are not available yet, it is hoped that 30 to y0 acres of land, <br />much of which is currently in the major disturbance class, will be <br />placed in minor disturbance. Most if not all of this work will be <br />completed by January 31, 1992. A map will be provided shortly <br />identifying the land where this rehabilitation will be done plus a brief <br />narrative describing the work to be done on each parcel of land. <br />Furthermore, the work will be thoroughly documented by ground based <br />photography on a weekly basis and copies of the photographs will be <br />supplied to the Division. <br />
