PERMIT NO.: CO-00321 l5, <br />Moffat county. <br />AMENDMENT: to exempt from WET testing when no mine water/spoils spring water is discharged <br />DISCHARGE: to tributaries to the Yampa River <br />INTENDED CIVIL PENALTIES: <br />Puroose of Public Notice: The purpose of this notice is to state the intent of the Water Quality Control <br />Division to petition for the imposition of a penalty against the Center Sanitation District. The Division <br />will seek imposition of a penalty of $19,418 of which $9,709 is to be conditionally suspended. This penalty <br />is sought pursuant to the Water Quality Control Act, S 25-8-608, C.R.S., for violation of the conditions of <br />CDPS Permit No. CO-0023035 as alleged io the Notice of Violation and Cease and Desist Order issued by <br />the WQCD on November 22, 1993. <br />The Center Sanitation District is located in Saguache County, Colorado and is authorized to discharge <br />treated wastewater to an umamed drainage ditch. <br />Tentative Determination: State tentative determinations have been made in conjunction with the U.S. EPA <br />that limitations and conditions imposed in these permits implement all applicable statutes and regulations and <br />water quality standards. <br />Public Meetines: Permit Action: Pursuant to 25-8-502(3)(b), by December 8. 1997, interested persons may <br />submit a written request for a public meeting on the tentative determination. T'he Division, after considering <br />all requests, may grant a public meeting for good cause shown. It will be held within sixty (60) days of the <br />date of public notice. <br />Public Comments: Permit Actions: Pursuant to 25-8-502(3)(c) interested persons may submit written <br />comments on the tentative determination provided they are received by [he Division by November 17. 1997. <br />All comments received prior to said date will be considered in the formulation of final conditions and <br />limitations. If a public meeting is held, the public comment period shall close sixty (60) days following the <br />public notice. <br />Following the public comment period and the public meeting, if one is held, the Department will issue or <br />deny the final permit. Interested parties then have thirty (30) days to request an adjudicatory hearing on the <br />permit. <br />Public Comments: Civil Penalties: Interested persons may submit written comments on the Intended Civil <br />Penalty provided they are received by December 8. 1997. <br />Mailine Address: Public comments should be directed to the CDPHE, WQCD-PE-B2, 4300 Cherry Creek <br />Drive South. Colorado 80222-1530. <br />Further Information: Permit Actions: The draft permit is available for inspection at your County <br />Commissioner's Office and County Health Department, or can be obtained by writing to the Division at the <br />above address and paying a small charge per page for copying fees. <br />Material Iniurr to Water Riehts: In accordance with C.R.S. 25-8-104 (2) (d) (1989), any person who <br />believes that any actions proposed in this notice have the potential to cause material injury to a water right is <br />advised to contact the Division, in writing by December 8. 1997. The written notification should explain <br />how the material injury will be incurred. <br />
