Upset: An exceptional incidwt in which them is unintentional and temporary noocomphance with permit <br />efFlttent limitations because of factors beyond dre reasonable watrol of the permittce. Aa upset does not include <br />noncompliance ro the extent caused by operatioml error, improperly designed treatment facilities, inadequate <br />treatment facilities, lack of preventative maintenance, or careless or improper operation. <br />3. Nonrnmoliance Notification <br />a. if, for any reason, the permittx does not comply with or will be usable to comply with any discharge <br />limitations or standards specified in this permit, the permittee shall, at a minimum, provide the Water Quality <br />Control Division and EPA with the following information: <br />1) A description of the discharge and cause of noncomplimce; <br />2) The period of noncompliance, including exact dates and times andlor the anticipated time whm the <br />discharge will return ro compliance; and <br />3) Steps being taken to reduce, eliminate, and prevent recurrence of the noncomplying discharge. <br />b. The permittee shall report the following instances of nonwmpliance orally within twenty-four (241 hours from <br />the time the permittx becomes aware of the noncompliance, end shall mail to the Division a written report <br />within five (Sl davs after becoming aware of the noncompliance: <br />1) Any insmnce of noncompliance which may endanger health or the environment; <br />2) Any unanticipated bypass; <br />3) Any upset which causes an exaeedance of any effluent limitation in the permit; <br />4) Any spill which cattcev any effluent limitation to be violated; <br />5) Daily maximum violations for any toxic pollutants or hazardous substances limited by Part I.B of this <br />permit and specified as requiring 24 hour notification. <br />c. The petmi[tx shag report all other instances of nou-compliance not requiring 24-hour notification at the time <br />Discharge Monitoring Reports ere submitted. The reports shall contain the information listed in sub-paragraph <br />(a) of this section. <br />4. Subnti~ion of inrnrrect or incomplete Information <br />Where the permittee failed to submit any relevant facts in ^ permit application, or submitted incorrect information in e <br />permit application or report to the Division, the permittee shall promptly submit the [eleven[ application information <br />which was sot submitted or any additional information Wended to correct any erroneous information previously <br />submitted. <br />5.
